TERMS AND CONDITIONS FOR THE PROVISION OF SERVICES AND BOOKING OF ONLINE VISITS AT APOLONIA DENTAL

1. General provisions
These Regulations (the “Terms and Conditions”) set out the rules for:


booking online visits and payment of the deposit through the payment system Przelewy24,


conclusion and execution of contracts for the provision of dental services,


withdrawal from a distance contract (to the extent provided for by law),


rules for filing complaints and refunds.


The Terms and Conditions are available free of charge on the website apoloniadental.pl in a form that allows you to download, save and print.


The NIP published on the website has a format of 10 digits and is in accordance with the data provided to Przelewy24.


2. Definitions
Patient — a person using the services of the Cabinet.


Service — website apoloniadental.pl and online booking form.


Deposit — the amount paid at the time of booking, constituting a deposit within the meaning of Article 394 of the Civil Code, counted against the price of the service. The legal effects of the pledge are described in § 7.


Payment Operator — PayPro S.A. (Przelewy24), ul. Pastelowa 8, 60‑198 Poznań, NIP 779‑236‑98‑87, KRS 0000347935, a national payment institution registered by KNF (No. IP24/2014).


3. Scope and nature of services
The office provides private dental services (diagnostics, prevention, conservative treatment, surgery, endodontics, prosthetics, and implantology — in accordance with the competence of the staff and the current price list).


Information about the main features of services, gross prices (including taxes) and possible additional costs is published in the price list: https://www.apoloniadental.pl/cennik. The requirement for transparency of information before concluding a contract arises from the consumer regulations and Przelewy24 guidelines.


4. Reservation of visits and conclusion of contract
Online booking is made by filling out the form, choosing a date, accepting the Terms and Conditions and paying the deposit by Przelewy24.


The contract for the provision of medical services is concluded remotely upon receipt by the patient of the booking confirmation (email/SMS) after successful payment.


The deposit is credited against the price of the service performed on the agreed date.


5. Online payments (Przelewy24)
Online payments are made by PayPro S.A. (Przelewy24) — a national payment institution. Operator data: PayPro S.A., ul. Pastelowa 8, 60‑198 Poznań, NIP 779‑236‑98‑87, KRS 0000347935.


Available payment methods include, among others, fast online transfers, payment cards, and BLIK — in accordance with the current offer of the Operator.


Refunds of funds (e.g., after withdrawal from the contract or change/cancellation of the visit in accordance with the Regulations) are made by the same payment method used by the patient, unless the patient has agreed to another, at no additional cost.


6. Right of withdrawal from a distance contract (patient-consumer)
Special rules apply to contracts for health services provided by health workers: as a rule, the Consumer Rights Act does not apply, but in the case of contracts concluded at a distance or off-premises, certain provisions apply, including information obligations, rules for starting services upon explicit request and the right of withdrawal with certain exceptions.


A patient-consumer who has concluded a distance contract may withdraw from the contract within 14 days of its conclusion, without giving reasons and without cost, with the exceptions provided for by law (in particular Article 38).


Exception: if the service has been fully performed with the express and prior consent of the patient, who has been informed that after the performance of the service he will lose the right of withdrawal—the right of withdrawal is not available (Article 38 (1)).


If the patient requests the start of the service before the expiry of the withdrawal period and then withdraws, he is obliged to pay for the services fulfilled at the time of withdrawal, in proportion to the scope of the provided service (Article 35).


In the event of an effective withdrawal, the Office immediately, no later than 14 days from the date of receipt of the statement, reimburses the patient all payments received (including the deposit), in principle by the same method of payment.


The model of the withdrawal form is set out in Appendix No. 1 to the Regulations.


7. Deposit — detailed rules (Article 394 of the Civil Code)
The amount paid when booking is a deposit within the meaning of Article 394 of the Civil Code and is included in the price of the service.


Resignation or non-attendance of the patient: if the patient does not show up for the appointment or cancels the appointment later than 48 hours before the appointment without good reason, the office may withdraw from the contract and keep the deposit. (Note: this provision does not limit the statutory right of withdrawal in § 6).


Cancellation of the visit by the Office for reasons lying on the side of the Office — The patient may withdraw from the contract and demand the return of the deposit in double amount.


Termination of the contract by agreement of the parties or inability to provide (force majeure) — the deposit is refundable in nominal value.


In case of timely change of appointment by the patient (no later than 48 hours before the due date), the deposit paid is transferred to the new appointment (one-time).


The rules of this paragraph shall be applied with due regard to the mandatory consumer regulations indicated in § 6.


8. Complaints about services and payments
Complaints regarding the quality of services and settlements can be submitted in writing or by e-mail to the following address: info@apoloniadental.pl or in the Office.


The Cabinet will respond within 14 days of receipt of the complaint (Article 7a of the Consumer Rights Act — deadline for responding to a consumer complaint).


In case of recognition of the complaint, the funds are returned immediately by the same method of payment, unless the patient agrees to another, without costs.


9. Refunds (technically)
Refunds of funds from payments made by Przelewy24 are made through the Payment Operator to the account/card/primary payment method, in accordance with the regulations and system capabilities of the Operator.


10. Prices and settlements
All prices are gross prices (including taxes).


The current price list and information on possible additional costs (e.g., imaging tests, prosthetic materials) can be found on the website apoloniadental.pl/en/cennik. Before placing an order/booking, the patient receives clear information about the price and the method of payment — which is also required by Przelewy24.


11. Protection of personal data
The administrator of patients' personal data is Apolonia Dental Wojciech Gącienica-Ciułacz.


Detailed information on the purposes, legal bases, storage periods and rights of patients can be found in the Privacy Policy available at https://www.apoloniadental.pl/en/polityka-prywatnosci.


Data concerning online payments are also processed by PayPro S.A. (Przelewy24) as a separate administrator/processor — in accordance with its policies.


12. Final provisions
In matters not regulated by the Regulations, the provisions of Polish law apply, including the Civil Code and—to the extent indicated in § 6—the Act of 30 May 2014 on consumer rights.


The Terms and Conditions may change for important reasons (e.g., change of law, change of payment method). The changes do not affect the rights of patients to appointments already booked.


The current version of the Terms and Conditions is always available on the website apoloniadental.pl/en/regulamin.
